These Terms of Service (“Terms”) govern your access to and use of the services, software, applications, websites, hardware, and related products provided by HOBBS ELD INC. (“Hobbs ELD”, “Company”, “we”, “us”, or “our”), including the website located at https://hobbseld.com, the Hobbs ELD mobile applications for Android and iOS, the web-based platform, and proprietary Electronic Logging Device hardware (collectively, the “Services”).
By accessing, installing, registering for, or using any part of the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.
You represent and warrant that you are at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or the entity you represent, including motor carriers, fleet operators, and drivers. If you are using the Services on behalf of a company, you agree that such entity is bound by these Terms.
Hobbs ELD is an Electronic Logging Device provider offering software applications for Android, iOS, and web platforms, together with proprietary ELD hardware designed to record, store, and transmit data required for compliance with applicable transportation laws and regulations, including but not limited to FMCSA ELD and Hours of Service (HOS) regulations.
The Services include, but are not limited to, driver log management, duty status tracking, vehicle data collection, GPS location tracking, compliance reporting, data transfer to authorized officials, administrative tools, and customer support.
Subject to these Terms, Hobbs ELD grants you a limited, non-exclusive, non-transferable, revocable license to access and use the software and Services solely for your internal business purposes and only in connection with authorized Hobbs ELD hardware. The Services are licensed, not sold.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, decompile, or otherwise attempt to derive the source code of the Services or hardware firmware, except as expressly permitted by law.
Hobbs ELD proprietary hardware is provided for use solely in connection with the Services. Ownership of hardware may be subject to purchase, lease, or subscription terms. Unauthorized modification, tampering, resale, or use of hardware outside its intended purpose is prohibited and may result in service suspension or termination.
You are responsible for ensuring that all information entered into the Services is accurate, complete, and current. You agree to use the Services in compliance with all applicable laws, regulations, and industry requirements. You acknowledge that compliance with transportation regulations remains your responsibility, and Hobbs ELD does not provide legal advice.
You retain ownership of your data. By using the Services, you grant Hobbs ELD a limited right to collect, process, store, and transmit data solely to provide the Services, comply with legal obligations, and improve functionality.
You acknowledge that authorized regulatory officials may access ELD records during inspections or audits as required by law.
We strive to maintain continuous availability of the Services but do not guarantee uninterrupted or error-free operation. The Services may be temporarily unavailable due to maintenance, updates, network issues, or circumstances beyond our control.
Certain Services may require payment of fees pursuant to subscription plans or agreements. Failure to pay applicable fees may result in suspension or termination of Services.
Hobbs ELD may suspend or terminate access to the Services at any time if you violate these Terms, misuse the Services, fail to pay applicable fees, or if required by law. Upon termination, your right to use the Services will immediately cease.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOBBS ELD DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOBBS ELD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, OR REGULATORY PENALTIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL HOBBS ELD’S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Hobbs ELD from and against any claims, damages, liabilities, losses, and expenses arising from your use of the Services, violation of these Terms, or violation of applicable laws or regulations.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.
We may update these Terms from time to time. Updated Terms will be posted on our website with a revised effective date. Continued use of the Services constitutes acceptance of the updated Terms.
